Case Description

On the evening of September 23, 2001, a 10,000-gallon capacity tanker truck failed to navigate a curve on Route 137 purportedly to avoid hitting a deer, veered off the road, crashed through a guardrail and small building, and came to rest along the southwest shore of Sanborn Pond in the Town of Brooks, Maine. The accident punctured the tanker, and an estimated 5,600 gallons of Number 6 fuel oil flowed onto the 98-acre pond covering approximately three-quarters of it with oil.
